Enchanted On Conadilly Online Sales Terms and Conditions

Welcome to Enchanted On Conadilly’s Online Sales Terms and Conditions. These Terms and Conditions govern sales made on the Enchanted On Conadilly online sales webpage. You agree to be bound by these Terms and Conditions by clicking on the “I agree with the terms of service and I adhere to them unconditionally” button on the checkout page.

We reserve the right to amend these Terms and Conditions at any time by posting amended terms and conditions on our website with a revised effective date.

The terms “Enchanted On Conadilly”, “us”, “'we” and “our” refers to Enchanted On Conadilly.  Our contact details are listed on the website page "Contact Us". The term 'you' refers to the purchaser of the product or user or viewer of the online ordering features of our website.

FASHION & GIFTWARE - Warranties & Returns

 Australian Consumer Law – Refunds & Returns states:

“We are not required to provide a refund or replacement if you change your mind”, which includes:

  • Changed your mind/wrong size
  • Ordered the incorrect product (Please read the descriptions)
  • Found another product cheaper elsewhere
  • Found a better product elsewhere
  • Were aware of any fault before buying it
  • Damaged the product by wearing it, washing it incorrectly, or longtime wear & tear.

“You can choose a refund if an item has a major problem” which includes:

  • A problem that would have stopped someone from buying the item if they had known about it
  • Is unsafe
  • Is significantly different from sample or description
  • Doesn’t do what we said it would, or what you asked for and can’t be easily fixed.

I’ve received my fashion order and am not completely happy with it?

If you are not entirely happy with your purchase, we are happy to issue you with a credit if the item has been returned to us with in 7 Days from purchase on any FULL PRICED items.

If you choose to return your FULL PRICED item for a REFUND, an Administration Fee of $9.90 will be retained from the refund amount.

All returns must be in their original unworn condition with original tags attached.

Can I return items I've had on layby?

If you choose to layby an item instore, this is with the understanding that you intend to purchase the item in full.

If you change your mind within 30 Days and you no longer wish to continue with the purchase of your item, we can cancel the layby for a store credit ONLY.  If you have paid the item outright and you have not collected it from the store, then the item is considered yours and we are holding it instore as a courtesy to you.  If you change your mind on an item we do not accept returns on those items, nor will we issue refunds.

Return Process:

We ONLY accept returns on FULL PRICED items.

When you receive your item and you decide you are not happy with it, please contact us via email immediately on info@enchantedonconadilly.com.au quoting the order number, date of purchase and email address used for the order.

We will then reply with a “Return Number” to quote on your return.  Postage on return is at your own expense.  The return is to be received by us within 7 days.

Note:  If you return an item to us that doesn’t have an RN number and we’ve not been notified of the return, the parcel will be “return to sender” for which you will be charged.

Warranties:

All fashion items are thoroughly checked before they are posted out.  If you receive an item that you feel isn’t in perfect condition, please follow the above process for a return, also including photo of damage.  This must be done within 4 days of you receiving the item.  After 4 days you will no longer qualify for a Warranty Return.

The Warranty does not cover damage arising from dye transference/fading after washing. Accident or misuse, or from any alteration, service or repair performed by any other party other than Enchanted On Conadilly.

FLORAL DELIVERIES:

Deliveries for Floral Arrangements & Gift Hampers can be arranged for the TOWNSHIP ONLY of Gunnedah, Curlewis & Boggabri.  Deliveries to Rural Farm addresses is NOT AVAILABLE.

SAME DAY DELIVERY ONLY GUARANTEED FOR ORDERS RECEIVED PRIOR TO 12 NOON

Price:

Prices listed are for immediate ordering only and are subject to change. Prices do not include shipping (unless stated or a promotion is in place), which will be charged separately. Prices include GST for Australian residents.  You will be responsible for paying any taxes for orders shipped to addresses outside of Australia.

Availability:

If you are placing an order for flowers, they will be delivered the day you nominate them to be delivered. Depending on Season there may be variations to the actual flowers used in the arrangements pictures, however we will do our best to match the colours and the style of the arrangement as shown.

Shipping:

For clothing ordering we typically ship products on the same day you order them.

Furniture Items may have longer lead times (usually noted on the product description page). We will email you a confirmation of lead time for your order if it will be longer than expected.

Free local delivery is available for Furniture Items.  Out of town items will attract an additional delivery fee.

Payment Options:

We accept PayPal, Afterpay & Zippay, Credit Card payments for online orders.  Credit Card payments are processed instore and will be done during working hours.

We also offer attract Credit options through Lattitude Finance. You can apply for a line of credit through their online portal. Once a card has been received we can process interest free options instore, or you can use your card and through the app apply that purchase to interest free terms offered by Lattitude.

Shipping, Title, Risk of Loss and Insurance:

We will choose, and deliver your order to, a shipping company, which will be deemed your agent. All shipments are made “FOB Origin”, meaning the sale is final, our delivery to you is deemed complete, and risk of loss or damage transfers to you, upon our delivery of your order to the shipping company. If your order is lost or damaged in shipment, you will have to make the claim against the shipping company. We do not insure your shipment. IF you require insurance, please contact us prior to checkout.

Refunds & Returns on Furniture:

Under the Australian Consumer Law we are not required to provide a refund if you change your mind about the services you asked for.

But you can choose to cancel your contract, and receive a refund for unconsumed services, if the service has a major problem. This is when the service:

  • has a problem that would have stopped someone from purchasing the service if they had known about it
  • is substantially unfit for its common purpose, and can’t be easily fixed within a reasonable time
  • does not meet the specific purpose you asked for and cannot be easily rectified within a reasonable time
  • creates an unsafe situation.

If you choose to continue with the contract, you can ask us to compensate you for any difference in the value of the services we provided and what you paid.

If the problem is not major, we will fix it within a reasonable time. If it is not fixed within this time, you can choose to have someone else fix the problem and recover all reasonable costs from us. If the problem cannot be fixed, we view it as a major problem.

It is our intent to give your the most imformation possible about an item before your purchase it. Please read the item description and take note of the dementions listed for the item.  We do not accept refunds or returns on items that you have selected and ordered based on your own misunderstanding of the description. No Delivery to Specified Persons or Entities or Countries:

A variety of laws prohibit or restrict our ability to deliver products to certain specified persons, entities or countries. Except as authorized by law, you agree not to export or re-export products to any country, or to any person, entity, or end user subject to Australian export controls, including without limitation countries subject to Australian embargoes or trade sanctions and persons or entities otherwise so identified by the Australian government.

Warranty:

Manufacturer warranties apply to our products. The warranty period for the repaired or replaced product will not exceed the original warranty period. You must contact us to obtain a return material authorization (“RMA”) number prior to returning your product for warranty repairs; packages received without an RMA clearly listed on the outside of the package will be rejected. The warranty does not include apply to any product problems we determine have been caused by accident, abuse, or negligence, or by damage by water, heat, dust or other environmental cause, or by unauthorized repair or modification.

THE FOREGOING WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EITHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING THE PRODUCTS, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

IN NO EVENT WILL WE BE RESPONSIBLE OR LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS, OR INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL OR CONTINGENT DAMAGES ARISING FROM OR RELATING TO THIS CONTRACT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THIS SALE, INCLUDING FOR ANY LIABILITY ON ACCOUNT OF A CLAIMED DEFECT IN ANY PRODUCT, WHETHER IN CONTRACT OR TORT OR OTHERWISE, SHALL IN NO EVENT EXCEED THE PURCHASE PRICE OF THE PRODUCT. ALL SALES ARE FINAL, NO RETURNS WILL BE ACCEPTED OTHER THAN AS PROVIDED IN THESE WARRANTY PROVISIONS.

Interpretation: These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia, without reference to its conflicts of law provisions.  Any dispute shall be subject to the exclusive jurisdiction of the courts located in Australia, and you hereby irrevocably agree to submit to the personal and exclusive jurisdiction and venue of such courts. The various section headings used herein are inserted for convenience of reference only and shall not affect the meaning or interpretation of these Terms and Conditions or any section thereof. If any term, provision, covenant or condition of these Terms and Conditions is held by a court or arbitral panel of competent jurisdiction to be invalid, void or unenforceable, the remainder of the provisions hereof shall remain in full force and effect and shall in no way be affected, impaired or invalidated.
